Preliminary research, although less expensive, still requires a comprehensive search, even if seemingly clear. The reason being is that a search is never complete until you comprehensively search Federal trademarks, (2 million), State trademarks (1 million), AND US National Common-Law (16 million) trade names.
Legal problems may exist if your trade name is Conflicted -OR- if a Strong Similar name is found - in sound, appearance or meaning.
TradeMark Express keeps search fees low by splitting your research into 2 searches, the US Federal & State trademark search and the US National Common-Law search. Many of our competitors will charge & conduct both searches regardless of any findings; that means a lot of unnecessary research.
If your trademark search appears to be blocked, we will hold onto your common law search, until you have a chance to verify any Conflicts or Strong Similarities and speak to one of our trademark attorneys, at no charge (nominal cost for the West Coast attorney). We will follow the same procedure, if your common law search is blocked, before proceeding to prepare your trademark application. Below is TradeMark Express' pricing list for all services. $150 - US Federal & State Trademark Research
- Before TradeMark Express conducts the comprehensive research, we will do a FREE check for the exact name at the USPTO. If there is a Conflict, we will call to inform you so you may provide us with your 2nd choice name.
- 3+ million trademarks are searched - the USPTO Federal trademarks (2 million) as well as the 50 Secretary of State databases (1 million). This search covers registered and pending applications.
- The fee includes same day (if ordered by 2pm EST) or next business day service, fully documented comprehensive research, and FREE legal referral (if needed; nominal cost for the West Coast attorney).
- Results are emailed as an attachment, enabling you to print a copy as well as save to your hard drive (doing both is strongly recommended). Your researcher will also call you upon sending to discuss your search results.
- If the US Federal & State trademark search is clear we'll proceed to the US National Common-Law search. If blocked, we'll consult with you about your options. Free legal referral to one of our attorneys will be provided, if necessary.
$50 - US Federal & State Trademark Research Analysis
When TradeMark Express analyzes your comprehensive research, you will save well over $300 of trademark attorney time. We'll determine if there are similar names in Sound, Appearance and Meaning that actually affect your legal use of your proposed trade name. Similar names are much more likely to affect your legal use than obvious exact name conflicts.

- Over 16 million trade names are searched - yellow pages, corporations, DBA fictitious name filings, company directories, newspapers, trade journals, court records, tax records, municipal records, credit records, product databases, industry sources, etc.
- If there are any Conflicts or Strong Similarities found in the US Federal & State trademark files, the US National Common-Law research is suspended until you have an opportunity to discuss the findings with one of the referred attorneys. This saves our clients money if the Common-Law research proves to be unnecessary due to blocks within the Trademark files.

TradeMark Express' common law search is truly comprehensive because we will research up to 6500 paid databases on Lexis-Nexis or Dialog to make sure your proposed trade name is not being used anywhere. Many of our competitors say they offer comprehensive research yet will only visit the main few databases. This does not accomplish the job for you. Their common law research practice is not truly comprehensive.

USPTO trademark application preparations are $300 off, when you order our TradeMark Express research package including your needed research. You save $300, ie: $300-$100=$200 per name + up to $100 savings at the USPTO = $300, when we file your trademark electronically using (TEAS), using standard classification language, instead of filing a traditional paper application. The USPTO fee is $325 per class.
The State governments and Federal government charge filing fees separate from our fees. States fees vary from $10 to $125.
